1. Agreement to Terms

2. Use License

Permission is granted to temporarily download one copy of the materials on Editute's website for personal, non-commercial transitory viewing only.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Editute at any time.

3. Account Responsibilities

When you create an account with us, you are responsible for:

All payments are processed securely through our payment partner, Paddle. We do not store your payment card information on our servers.

5. Intellectual Property Rights

All content, features, and functionality on Editute, including but not limited to:

  • Practice questions and exam materials
  • Study guides and learning resources
  • AI algorithms and score prediction models
  • Software, graphics, logos, and design elements
  • Text, images, and other content

are owned by Editute and are protected by United States and international copyright, trademark, patent, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or publicly perform any content from our service without our prior written permission.

6. Prohibited Conduct

You agree not to use the service for any purpose that is prohibited by these Terms. You are responsible for all of your activity in connection with the Service. Prohibited activity includes:

  • Any attempt to copy, distribute, or leak exam questions or proprietary content
  • Using the service for cheating or academic dishonesty
  • Sharing account credentials with third parties
  • Attempting to gain unauthorized access to our systems or other users' accounts
  • Using automated tools or bots to access the service
  • Reverse engineering or attempting to extract source code from our platform
  • Harassing, threatening, or impersonating other users
  • Uploading viruses, malware, or any harmful code
  • Using the service to violate any applicable laws or regulations

Violation of these terms may result in immediate account termination and potential legal action.

7. User-Generated Content

If you submit, upload, or post content to Editute (such as notes, comments, or feedback), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content in connection with operating and improving our services.

You represent and warrant that you have all necessary rights to grant this license and that your content does not violate any third-party rights or applicable laws.

8. Disclaimer

The materials on Editute's website are provided on an 'as is' basis. Editute makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Important: Our AI-powered score predictions are estimates based on your performance data and statistical models. Actual exam scores may vary. Editute does not guarantee any specific test scores or admission outcomes.

9. Limitations of Liability

In no event shall Editute or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Editute's website, even if Editute or an authorized representative has been notified orally or in writing of the possibility of such damage.

Our total liability to you for any claims arising from your use of the service shall not exceed the amount you paid to Editute in the 12 months preceding the claim.

10. Termination

We reserve the right to terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms of Service
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Requests by law enforcement or government agencies

Upon termination, your right to use the service will immediately cease. You may delete your account at any time from your account settings.

11. Dispute Resolution and Arbitration

Any dispute arising from these Terms or your use of Editute shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement.

There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award the same damages and relief as a court.

12. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the United States and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.
